Terms of Service

These Terms govern your use of gottaSay ("the Service"), available at gottasay.app. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

The Service is operated by Altimcode, registered in the Republic of Serbia, tax identification number (PIB) 108662389, company registration number (matični broj) 63609960. You can reach us at contact@gottasay.app.

2. What the Service does

gottaSay lets account holders create digital suggestion boxes, polls, and ratings, and lets anyone with a link or QR code respond to those boxes anonymously. A poll or rating box may also ask one follow-up question after the answer, or offer a link to another site such as a review page. Account holders see the responses through their dashboard, and on plans that include it they can share a box with other account holders.

3. Your account

To create boxes you must sign in with a Google, GitHub, or LinkedIn account. You agree to:

  • provide accurate information;
  • keep your account credentials secure;
  • be responsible for activity that takes place under your account.

You may close your account at any time.

4. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose;
  • submit, host, or distribute content that is illegal, threatening, defamatory, harassing, hateful, infringing, deceptive, or sexually explicit involving minors;
  • attempt to identify, harass, or retaliate against individual responders;
  • attempt to disrupt the Service, bypass security measures, or access the Service or its data in ways not permitted by these Terms;
  • use automated tools to flood, spam, or otherwise abuse the response process;
  • resell, sublicense, or commercially exploit the Service without our prior written consent.

We may remove content or suspend or terminate accounts that violate these rules.

5. Your content

You retain ownership of the content you create or submit through the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content for the purpose of operating and providing the Service.

If you create a box, you are responsible for:

  • the lawfulness of the questions you ask;
  • how you handle the responses you receive;
  • any link you offer at the end of a box, including whether the site you send people to allows you to ask only some responders for a review;
  • complying with applicable privacy and consumer protection laws in respect of your responders, including informing them how their responses will be used.

6. Responses

Responses submitted to a box are visible to the owner of that box and to anyone that owner has shared the box with. Where a box asks a follow-up question, the answer to it forms part of the same response and is visible in the same way. By submitting a response, you confirm that the content is your own and does not violate these Terms. Do not submit personal data or sensitive information about yourself or others unless explicitly asked to.

A box owner may choose to offer a link to another site at the end of a response, such as a review page. That destination is chosen by the box owner and is not operated by us. Following it is optional, and once you do, that site's own terms and privacy policy apply rather than ours.

7. AI features (optional)

For Suggestion boxes, you may optionally connect your own API key for a third-party AI provider (currently OpenAI, Anthropic, or Google) and use it to summarise the responses submitted to your boxes and to sort them into good, neutral, and bad. These features are off by default and only run when you ask for them.

  • You are responsible for obtaining and paying for your own API key with the provider you choose. We do not charge for this feature and have no control over, or responsibility for, that provider's pricing, availability, rate limits, or terms of service.
  • When you ask for a summary or for your responses to be sorted, the relevant response content is sent to your chosen provider for processing. That provider processes it under its own privacy policy and terms, not ours — see our Privacy Policy for how we handle this.
  • We store your API key encrypted and use it solely to fulfil the AI requests you initiate. You can remove it at any time from your account settings.
  • We do not warrant the accuracy, completeness, or appropriateness of AI-generated summaries or sentiment labels. Review them before relying on them.

8. Privacy

Our handling of personal data is described in our Privacy Policy.

9. Service availability

The Service is provided on an "as is" and "as available" basis. We do not promise that it will always be uninterrupted, error-free, or available in any specific region. We may change, suspend, or discontinue features at any time.

10. Pricing

The Service offers a free plan and paid subscription plans. Current prices, and the monthly response and box limits that apply to each plan, are set out on our pricing page. Paid plans are billed in advance on a recurring basis through our payment provider; see our refund policy for billing, cancellation, and refund terms.

All of your boxes draw on one monthly response allowance. The month runs from your first response, and the allowance refills a month later; it is not tied to your billing date. If your account reaches the allowance before then, your boxes stop accepting new responses until it refills or you upgrade. The limit on how many boxes you may have is a standing one rather than a monthly allowance: it does not refill, so reaching it means deleting a box or upgrading before you can create another.

We may change plan prices and limits, with reasonable notice for changes affecting an active subscription.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or applicable law. You may stop using the Service at any time. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will continue to apply.

12. Disclaimer and limitation of liability

To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, express or implied. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from these Terms or your use of the Service will not exceed the amount you paid us in the twelve months preceding the claim (which, on the free tier, is zero).

13. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will reflect any changes. Material changes will be communicated through the Service. Continued use after the changes take effect constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts of the Republic of Serbia.
